A DWI Arrest can be based on your ability to operate a vehicle responsibly and prudently. If a police officer believes your ability to do this is impaired by the consumption of alcohol, he may charge you with DWI. In this case, the officer is looking for specific signs of impairment, usually by requesting that you submit to a battery of field sobriety tests. These test generally include-
- Nystagmus test – where the officer checks for involuntary movements of the eye
- The Standing on One Leg Test – where the officer is gauging your ability to stand still
- Walk and Turn test- in which the officer is gauging your ability to balance
- The Rhomberg Test – a stationary balance test where the officer generally requests that you stand with feet together and touch your nose or look at the sky
The officer may also be looking for other signs, such as slurred speech or the odor of alcohol on your breath. If the officer believes you are impaired, you can be arrested.
You can also be arrested without any signs of driving ability impairment if you submit to a chemical test that results in blood alcohol content (BAC) of 0.08 or more for drivers over the age of 21, or 0.02 for underage drivers, and 0.04 for commercial drivers.
